Terms and conditions for the MasterPass Race Promotion (the "Promotion")

1. Introduction

1.1 This Promotion is promoted and sponsored by MasterCard Asia/Pacific Pte Ltd (“MasterCard”)

2. General rules

2.1 By participating in the Promotion, a participant:

2.1.1 agrees to be bound by these terms and conditions without exception; and

2.1.2 who is under the age of 18 years, warrants that he/she has been duly assisted by his/her legal guardian, and that his/her legal guardian consents to the participant’s possession of the prize/s in the event that the participant wins such prizes.

The statements made in the paragraph above contain acknowledgments of facts by the participant. The participant must read the statements made in the paragraph above carefully and ensure that they are correct, as he/she will not be able to deny the truth of the statements. MasterCard and/or other persons may also have claims and other rights against the participant as a result of the statements made above.

2.2 A participant is entitled to enter into this competition if he/she is a natural person resident in the Republic of South Africa.

2.3 Only participants who are mobile 'pre-paid customers' are eligible to receive Rewards (defined below). 'Contract customers' are not eligible to receive Rewards. However, contract customers shall be entitled to donate their Rewards to pre-paid customers.

2.4 The Promotion is not open to directors, members, partners, employees, agents or consultants of MasterCard, any person who directly or indirectly controls or is controlled by MasterCard, or any supplier of goods or services in connection with the Promotion, or the spouses, life partners, business partners or immediate family members.

2.5 The Promotion runs from 4 July 2016 to 30 September 2016 (the "Promotion Period"). There is no fee charge for participating in the Promotion, other than the cost of accessing the Internet.

2.6 The Rewards and the Grand Prize (described in clause 3 below) are not exchangeable for cash and are not transferable.

2.7 MasterCard reserves the right, acting reasonably, to amend the rules of the Promotion. We will notify you via USSD of any significant changes to these rules. Your acceptance of any such changes (as notified to you via USSD) is required in order for you to continue participating in the Promotion. MasterCard further reserves the right to terminate the Promotion immediately and without notice if circumstances beyond its reasonable control prevent MasterCard from continuing to conduct the Promotion. In the event of such termination, as far as the law allows, all participants acknowledge that they will have no recourse against MasterCard in respect thereof.

2.8 As far as the law allows, all warranties and representations in relation to the Rewards and the Grand Prize not set out in these rules (whether express, implied or tacit) are hereby excluded.

2.9 As far as the law allows, neither MasterCard, its associated companies, nor the directors, officers, employees or agents of MasterCard shall be liable for any loss or damage, whether direct, indirect, consequential or otherwise, arising from any cause whatsoever which may be suffered as a result of entering the Promotion, the provision of the Rewards and/or the Grand Prize, or any act or omission of any other person. This clause 2.9 does not purport to limit or exempt MasterCard for any loss directly or indirectly attributable to its gross negligence or that of any person acting for or controlled by it.

This paragraph limits and excludes obligations, liabilities and legal responsibilities which MasterCard may have towards the participant and also limits and excludes the participant's rights and remedies against MasterCard and other persons.

2.10 These rules shall be governed by the laws of South Africa. The participant consents to the non-exclusive jurisdiction of the Johannesburg High Court, Johannesburg, in respect of all matters arising out of or in connection with the Promotion or these rules.

2.11 If any provision of these rules is found to be invalid or unenforceable by any court of competent jurisdiction, then that provision shall be severed from these rules and shall not affect the validity or enforceability of any remaining provisions.

2.12 It is not intended that any provision of these rules contravenes any provision of the Consumer Protection Act, 68 of 2008, and therefore all provisions of these rules must be treated as being qualified, if necessary, to ensure that the provisions of the Consumer Protection Act are complied with.

2.13 MasterCard shall not be responsible for a participant's failure to access the Promotion for any reason whatsoever including, by way of example only, as a consequence of communications or network failures.

3. Competition Mechanics

3.1 How to enter

3.1.1 In order to participate in the Promotion, participants are required to play the MasterPass Race game (the "Game"), which may be accessed by dialling *117*4863# from your mobile phone if you are a Vodacom subscriber, and *136*777# from your mobile phone if you are an MTN subscriber. You will require a mobile phone or similar electronic communications device to access the Game.

3.1.2 The Game requires the participants to match items to merchants, complete challenges and memorise MasterPass information with the aim of gaining access to the Rewards (as described in clause 3.2 below). Upon completion of the Game, and once you have downloaded and accessed the MasterPass App, you will be entered into a draw for the Grand Prize (as described in clause 3.3 below).

3.2 The Rewards

3.2.1 The participant shall receive the rewards specified in clause 3.2.2 below upon completing the numerous tasks in the Game: (a) the various levels in the Game; (b) providing certain personal information; (c) downloading the MasterPass App; (iv) answering 'checkpoint' questions correctly; and (v) using the MasterPass App.

3.2.2 The rewards for participating in the Promotion are as follows:

3.2.3 The Reward will be received on your mobile phone in the form of 'points', which may be converted into airtime. 100 (one hundred) points is equivalent to ZAR 1,00 (one South African Rand) in airtime. The maximum Reward that a participant will receive for participating in the Promotion is 2500 (two thousand five hundred) points, which may be converted to ZAR 25,00 (twenty five South African Rand) in airtime.

3.2.4 The participant shall be required to redeem the points and convert it into airtime by his/herself, by visiting the Game menu and selecting >Rewards >Spend Points. A participant shall only be entitled to redeem their points upon completion of one or more of the tasks.

3.3 The Grand Prize

3.3.1 Upon completion of the Game, and once the participant has downloaded and accessed the MasterPass App, the participant shall be entered into a lucky draw for a chance to win an iPhone and data bundles (the "Grand Prize").

3.3.2 A winner will be selected by lot or chance, by means of a random draw, which will be announced by 14 October 2016. The determination of the winner is final and no correspondence will be entered into.

3.3.3 MasterCard may require the winner to provide it with additional information as it may reasonably require in order to confirm the identity of the winner and to process and/or facilitate the winner's use of the prize.

3.3.4 The Grand Prize will be sent by courier service, to the address the winner provides to MasterCard, by no later than one (1) month after the results are made available. MasterCard will not be held responsible for any failure by the courier to deliver a prize, or any winner's failure to accept delivery of his/her prize.

3.3.5 The winner may be asked to participate in publicity and marketing activities, including having their photograph taken, but the winner is entitled to decline to do so.

4. Privacy

4.1 In connection with your participation in the Promotion, we may collect certain personal information about you directly from your participation in the Promotion on your mobile device, such as: your age, mobile number, gender, income bracket, information on bills/expenses, the bank that issued your MasterCard card, and whether you use mobile apps.
