MasterPass Race Promotion Privacy Notice

We at Mastercard Asia/Pacific Pte Ltd ("Mastercard") respect your concerns about privacy. This Privacy Notice applies to the MasterPass Race Promotion (the "Promotion"). It describes the types of personal information we collect in connection with the Promotion, the purposes for which we collect such personal information, the other parties with whom we may share it and the measures we take to protect the security of the personal information. It also tells you about your rights with respect to your personal information, how you can reach us to update your personal information or get answers to questions you may have about our privacy practices.

Personal Information We Collect

In connection with your participation in the Promotion, we may collect certain personal information such as: your age, mobile number, gender, income bracket, information on bills/expenses, the bank that issued your Mastercard card, and whether you use mobile apps.

We collect personal information about you directly from your participation in the Promotion on your mobile device.

How We Use the Personal Information We Collect

We may use the personal information we obtain about you to:

  • Provide the services and features of the Promotion ;
  • Inform and educate you about the MasterPass Application;
  • Assist Mastercard in understanding whether you could be a potential MasterPass Application user;
  • Operate, evaluate and improve our business (including by developing new products and services; analyzing our products, services and websites; and facilitating the functionality of our websites);
  • Monitor the use of and improve our interactive assets;
  • Perform data analyses (including anonymization of personal data) to determine, among other measurements, business performance, number of registrants, channels, transaction spend and site performance;
  • Enforce our Terms of Use of the Promotion;
  • Comply with applicable legal requirements, industry standards and our policies; and
  • Perform auditing, research and analysis in order to maintain, protect and improve our services.

We also may use the information in other ways for which we provide specific notice at the time of collection.

Personal Information We Share

We do not sell or otherwise disclose personal data we collect about you, except as described herein or otherwise disclosed to you at the time the data is collected.

Mastercard may share your personal information with our affiliates in the Mastercard group of companies outside of South Africa.

We share personal information to perform the services requested through the Promotion. We may share the personal information we collect with our affiliates and merchants.

We may also share personal information with our service providers who perform services on our behalf. We do not authorize these service providers to use or disclose such personal information except as necessary to perform certain services on our behalf or comply with legal requirements. We require these service providers by contract to appropriately safeguard the privacy and security of personal data they process on our behalf.

We also may disclose personal information about you (i) if we are required to do so by law or legal process, (ii) to law enforcement authorities or other government officials, or (iii) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss, or in connection with an investigation of suspected or actual fraudulent or illegal activity. We also reserve the right to transfer personal information we have about you in the event we sell or transfer all or a portion of our business or assets. Should such a sale or transfer occur, we will use reasonable efforts to direct the transferee to use personal information you have provided to us in a manner that is consistent with this Privacy Notice. Following such a sale or transfer, you may contact the entity to which we transferred your personal information with any inquiries concerning the processing of that personal information.

Your Rights and Choices

Subject to applicable law, you may (i) have the right to access certain personal information we maintain about you and obtain a copy of that personal information, (ii) update or correct inaccuracies in that personal information and (iii) object to our use of your personal information where it is likely to cause damage or distress. You may choose not to provide personal information to Mastercard. However, if you do not provide personal information when requested, you may not be able to benefit from the full functionality of the Promotion and/or we may not be able to provide you with relevant information or services.

How We Hold and Protect Your Personal Information

We may hold your personal information in a variety of ways, including in electronic form. We restrict access to personal information about you to those employees who need to know that information to provide products or services to you. We maintain appropriate, reasonable, technical and organisational safeguards that comply with applicable regulations to protect the personal information we have about you. We also take measures to destroy or permanently de-identify personal information when there is no longer a business need to keep the personal information. The types of measures we take vary with the type of personal information, and how it is collected and stored. Unfortunately, no data transmission can be guaranteed to be 100% secure. Thus, while we strive to protect your personal information, we cannot guarantee or warrant the security of any data transmission. However, should we have reasonable grounds to believe that your personal information has been accessed by any unauthorized person, we shall inform you as soon as reasonably possible.

Data Transfers

We may transfer or disclose the country in which the personal information was originally collected, including the United States of America. Those countries may not have the same data protection laws as the country in which you initially provided the personal data. When we transfer or disclose your personal information to other countries, we will protect that personal information as described in this Privacy Notice. By participating in the Promotion, you acknowledge that and consent to the transfer of the personal information, we collect about you, to recipients in countries other than the country in which you are resident.

We will notify you via USSD of any significant changes to our Privacy Notice. Your acceptance of any changes to the Privacy Notice (as notified to you via USSD) is required in order to continue participating in the Promotion.
