Promotion’s General Terms and Conditions
“Mastercard Always on Merchant Promotion” (the “Promotion”)
Below are the Terms and Conditions under which the promotional activity Mastercard Always on Merchant Promotion (hereinafter "the Promotion") will be developed and carried out. The persons wishing to participate (hereinafter "The Participant") recognize and accept that the development and execution of the Promotion will be subject solely and exclusively to these Terms and Conditions.
The Promotion is organized exclusively by Buzo Cafe, Chaud Cafe, Massy, Superpharm, Unipet & WiEat ("the Organizers"), located in Trinidad and is sponsored by Mastercard International Incorporated ("Mastercard"). The Organizers is solely and exclusively responsible for organizing the Promotion and offering the discount related to the Promotion.
PROMOTION MECHANIC
The following discounts will be provided to Participants who comply with these Terms and Conditions as part of the Promotion:
An Eligible Mastercard Cardholder (as defined below), from an eligible participant Bank, shall qualify for the benefits listed in this section, when the eligible Mastercard cardholder from an eligible Bank uses their Mastercard to purchase during the Promotion Period (as defined below) using his or her Mastercard branded Credit Card, Mastercard branded Debit Card or Mastercard branded Prepaid Card and otherwise complies with the participation requirements provided in these Terms and Conditions. For the avoidance of doubt, if the eligible Mastercard cardholder meets the criteria, then they shall receive the benefits listed below, from the Organizers.
· MASSY Stores: TT$27 cashback for all Mastercard Standard & Gold cardholders or TT$45 cashback for all Mastercard Platinum and Black cardholders who make purchases of TT$900 or more in a month using their Mastercard.
· SUPERPHARM: TT$8 cashback for all Mastercard Standard & Gold cardholders or TT$12 cashback for all Mastercard Platinum and Black cardholders who make purchases of TT$250 or more in a month using their Mastercard.
· UNIPET: TT$6 cashback for all Mastercard Standard & Gold cardholders or TT$10 cashback for all Mastercard Platinum and Black cardholders who make purchases of TT$200 or more in a month using their Mastercard.
· WIEAT: Free delivery for all Mastercard Standard & Gold cardholders, who purchase within 5km of the restaurant, ($30 value). $30 off delivery fees for other purchases. Free delivery for all Mastercard Platinum and Black cardholders who purchase within 10 km of the restaurant.
The Promotion is valid during the promotion period which begins at 12 a.m. on Tuesday, July 25th, 2023, and ends on December 31st, 2023 (the "Promotion Period").
FIRST: PARTICIPATION REQUIREMENTS
Individuals may participate in the Promotion if they comply with all the following:
1. They possess a valid and active Mastercard branded Credit Card, Mastercard branded Debit Card or Mastercard branded Prepaid card that has been issued in Trinidad, from one of the eligible Banks.
2. They charge all services/products consumed/purchased from Organizers to the above mentioned Mastercard card(s).
3. They accept these Terms and Conditions.
4. Participant is at least eighteen (18) years of age; and
5. The Mastercard branded Credit Card, Mastercard branded Debit Card or Mastercard branded Prepaid Card used for the purchase at the Organizers is open and in good standing with the financial institution that issued said Mastercard branded Credit Card, Mastercard branded Debit Card or Mastercard branded Prepaid Card.
SECOND: ACCESS TO THE DISCOUNT
To access the discount which is the subject of this Promotion each Participant must: agree that by receiving, using, or accepting the benefit of this Promotion, the Participant acknowledges to have read these Terms and Conditions and to have duly agreed to be absolutely bound by these Terms and Conditions.
THIRD: PROMOTION LIMITS
· MASSY: TT$27 cashback for all Mastercard Standard & Gold cardholders or TT$45 cashback for all Mastercard Platinum and Black cardholders who make in-store purchases of TT$900 or more in a month, at Massy Stores in Trinidad.
· SUPERPHARM: TT$8 cashback for all Mastercard Standard & Gold cardholders or TT$12 cashback for all Mastercard Platinum and Black cardholders who make in-store purchases of TT$250 or more in a month, at SuperPharm stores in Trinidad.
· UNIPET: TT$6 cashback for all Mastercard Standard & Gold cardholders or TT$10 cashback for all Mastercard Platinum and Black cardholders who make in-store purchases of TT$200 or more in a month, at Unipet Stores in Trinidad.
· WIEAT: Free delivery for all Mastercard Standard & Gold cardholders, who purchase within 5km of the restaurant, ($30 value). $30 off delivery fees for other purchases. Free delivery for all Mastercard Platinum and Black cardholders who purchase within 10 km of the restaurant.
· All Promotion only valid for Trinidad only.
FOURTH: CONSUMERS UNABLE TO PARTICIPATE
· The following individuals cannot participate in the Promotion: Participants who are younger than 18 years old.
· Participants who pay or partially-pay with a different method or banks than the one stated in the participation requirements (stated above).
FIFTH: ELIGIBLE BANKS
Republic Bank, First Citizens.
SIXTH: ILLICIT OR FRAUDULENT OPERATIONS AGAINST PROMOTION
The Organizers reserves the right to, in its sole discretion, invalidate any and all participation of any Participant, if the Organizers considers that the Participant has tried, or has effectively managed, to unlawfully or fraudulently manipulate the administration, security, equity and due execution of the Promotion.
SEVEN: OTHER LEGAL ISSUES
1. The discount and/or benefit which is the subject of this Promotion is personal and non-transferable.
2. This Promotion cannot be combined with other discounts and/or promotions and is not redeemable for cash.
3. The Organizers are exclusively and directly responsible to the Participants for the quality of the products and or services, as well as for compliance with all existing standards (during the Promotion Period) related to production, standards of health, marketing and use of the products/services that are the object of the Promotion. Mastercard does not provide any product and / or service, nor is responsible for the products or services that are the object of the Promotion, nor for human, technical or computer errors that cause the discount of this Promotion not to be received.
4. Neither Mastercard, nor its designees, nor assignees, nor any of their respective directors, employees, representatives and / or agents, will be liable for damages that are totally or partially due, directly, or indirectly, to the acceptance of the products or services offered by the Organizers, including physical, mental, or patrimonial damage, serious bodily injury or death.
5. By participating, it will be understood that the Participants have accepted these Terms and Conditions in their entirety.
6. These Terms and Conditions will be valid before the Organizers, independently of the proposals, offers and / or communications from the issuing banks, as well as third parties, directly related to these Terms and Conditions.
EIGHT: MODIFICATION OF THE TERMS AND CONDITIONS
To the extent permitted by the Trinidad legislation and if necessary, and/or at the discretion of the Organizers, the Organizers reserves the right to extend and/or clarify the scope of these Terms and Conditions, and/or any of the procedures, which will be communicated through the social networks and the Promotion website.
NINTH: AREA OF THE PROMOTION: Trinidad.
TENTH: APPLICABLE LAW
Participants acknowledge and agree that the applicable law of any dispute arising in relation to the activity will be that of in Trinidad and waives its right to initiate any type of claim in another jurisdiction.
ELEVEN: DISCLOSURE
