Eligibility
Open to MasterCard® cardholders 18 years of age or older residing outside of the Broward, Miami-Dade and Palm Beach counties as of the date of purchase. Must present personal identification with current address. Employees of Aventura Mall, Shopping Center Management, tenants of Aventura Mall and their respective parent and affiliated companies, as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible to participate. This Promotion is void where prohibited by local, state, or federal regulations.
Conditions to receive Voucher with Qualified Purchase
The Promotion is being conducted and sponsored by Turnberry Marketing Group LLC (the “Sponsor”) at the Aventura Mall beginning on January 1, 2013 at 10:00 a.m. Eastern Standard Time and continuing until earlier of (i) the date on which all gifts have been distributed or (ii) December 31, 2013 at 9:30 p.m. Eastern Standard Time (the “Promotion Period”). To be eligible to receive one (1) gift, you must use your MasterCard® card to purchase a minimum of five hundred and 00/100 dollars (USD $500.00), one thousand and 00/100 dollars (USD $1000.00) or one thousand five hundred and 00/100 dollars (USD $1500.00) or more worth of merchandise on a single day during the Promotion Period at one or more Aventura Mall merchants (the “Qualified Purchase(s)”) while supplies last. Each eligible participant will receive, free of charge, one gift upon presenting their MasterCard® card and matching valid original receipts(s) on the day of purchase evidencing the minimum amount of Qualified Purchases(s) to the MasterCard® Concierge Center during regular business hours while gift supplies last. Gift is non-transferable and may not be given, bartered or sold. There will be no cash substitutes for the gift. The Sponsor reserves the right to substitute a gift of equal or greater value should the gift become unavailable. Only one gift per person, per day during the Promotion Period.
Release of Liability
By participating in the Promotion, participant agrees to be bound by these Rules, which will be made available at the MasterCard® Concierge Center during the Promotion Period. The Promotion is being conducted and sponsored by Turnberry Marketing Group LLC (the “Sponsor”). The Sponsor will conduct the Promotion as described in these Rules, however, the Sponsor shall retain the right to abbreviate, extend, modify, or cancel the Promotion without notice or any further obligation due to events beyond its control. Participant agrees to release, discharge and save harmless Sponsor, MasterCard® International Incorporated, Aventura Mall, tenants of Aventura Mall and each of their respective officers, directors, employees, subsidiaries, and affiliates and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any and all claims, or causes of action, including, but not limited to, personal injury, death or damage to or loss of property arising out of participants participation in the Promotion and/or participant’s acceptance, use, misuse or possession of any gift, and/or any lost or misdirected gift(s). Participant will be responsible for all local, state and federal income taxes associated with any gift(s).
Governing Law
All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of participants and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Florida without giving effect to any choice of law or conflict of law rules.
