MasterCard® Priceless Memories Sweepstake™ Official Rules

No Purchase Necessary to Enter or Win. Purchasing Will Not Increase Your Odds of Winning. All entries, whether submitted by using a MasterCard card as described below, or via mail-in or online entry, have an equal chance of winning.

Eligibility:
The Sweepstakes is only open to MasterCard cardholders, whose accounts were issued by a Canadian financial institution and exist as of October 31, 2003 and who are legal residents of Canada over the age of majority in their province of residence, except employees (and those with whom they are domiciled) of MasterCard International Incorporated (“Sponsor”), MasterCard Canada, Inc. (“MasterCard Canada”), MasterCard member financial institutions, and each of their respective parent companies, affiliates, subsidiaries, and advertising/promotion agencies. Void where prohibited. This Sweepstakes is subject to all applicable federal, provincial, and local laws and regulations.

How to Enter:
1.) Automatically receive one Sweepstakes entry for each MasterCard card purchase made between 12:00:01AM EST on November 1, 2003 and 11:59:59PM EST on December 31, 2003 (“Promotion Period”). Account adjustment transactions/returns, PIN-based and international transactions, late payment fees, over-limit fees, cash advances, annual fees, and/or balance transfers are not considered eligible transactions for automatic Sweepstakes entry. Entries from unauthorized card use or made with lost, stolen, or fraudulent MasterCard cards are void. Winning accounts must be in good standing and not otherwise have privileges suspended, or;
2.) No Purchase Required. Receive one Sweepstakes entry when you (a) hand-print your name as printed on your MasterCard card, complete mailing address, telephone number, age, and the name of the financial institution that issued your MasterCard card on a plain 3" x 5" piece of paper and mail it in a sealed envelope to: MasterCard Priceless Memories Sweepstakes,™ 11 Prince Andrew Place, Toronto, Ontario, M3C 2H2. Enter as often as you wish by mail, but each entry must be mailed in a separate envelope with sufficient postage and postmarked no later than December 31, 2003 and received by January 7, 2004, or; (b) visit the MasterCard Priceless Memories Sweepstakes™ web page located at www.mastercard.ca during the Promotion Period, and fully complete the online entry form, including your name, complete mailing address, telephone number, age, and the name of the financial institution that issued your MasterCard card, in accordance with the instructions provided. Only one online entry per person or per e-mail address will be accepted per day of the Promotion Period. Any additional entries will be void. Incomplete entries are ineligible. No photocopied, computer-generated facsimiles, mechanically-reproduced, or mass entries permitted. Your use of your MasterCard card to make a purchase and/or your submission of a mail-in or online entry constitutes your consent to participate in this Sweepstakes and your consent for Sponsor to obtain and deliver your name, address, and other information to the contest judges for the purpose of administering this Sweepstakes and for other uses by Sponsor as permitted by applicable law. Sponsor is not responsible for lost, incomplete, illegible, late, misdirected, stolen, postage-due, or mutilated entries or mail; any error, omission, interruption, defect or delay in transmission or communication; technical or mechanical malfunctions; failures or malfunctions of phones, phone lines, or telephone systems; interrupted or unavailable cable or satellite systems; errors in these Official Rules, in any Sweepstakes-related advertisements or other materials; failures of electronic equipment, computer hardware or software, or; inaccurate entry information, whether caused by equipment, programming used in this Sweepstakes, human processing error, or otherwise. Sponsor reserves the right, at its sole discretion, to disqualify any entry, and, subject to the approval of the Régie des alcools, des courses et des jeux, to modify, terminate, or suspend this Sweepstakes should a virus, bug, non-authorized human intervention, action of entrant(s), or other cause corrupt or impair the administration, security, fairness, or proper play of the Sweepstakes, and, if the Sweepstakes is modified, terminated, or suspended, select winners from those eligible, non-suspect entries received prior to the event requiring such modification, termination, or suspension.

Prizes:
(3) Grand Prizes: Trip for winner and up to 19 guests from Canada to a single destination of winner’s choice with total trip expenses not to exceed $20,000 Cdn. Trip can include, but is not limited to, round-trip air transportation from nearest major airport to winner’s/guests’ residences in Canada, hotel or other accommodations, ground transportation, and any other expenses related to on-site trip activities which fall within the $20,000 Cdn. allocation such as, but not limited to, sightseeing excursions, food, entertainment, and spending money. Maximum retail value of Grand Prize not to exceed $20,000 Cdn. (Approximate Retail Value “ARV”=$20,000 Cdn.) All other expenses in excess of the $20,000 Cdn. maximum trip expenses are the responsibility of the individual winners. All trip and on-site trip activity arrangements, including the allocation of spending money, must be made prior to trip through travel agent of Sponsor’s selection and are subject to Sponsor’s final approval. If actual trip expenses as approved by Sponsor are less than $20,000 Cdn., the difference not to exceed $10,000 Cdn. will be awarded to winner to be used as spending money. Trip must be completed by January 2005. (25) First Prizes: (Option 1) Weekend trip for winner and up to 3 guests to a single destination of winner’s choice with total trip expenses not to exceed $4,000 Cdn. Trip can include, but is not limited to, round-trip air transportation from nearest major airport to winner’s/guests’ residences in Canada, hotel or other accommodations, ground transportation, and any other expenses related to on-site trip activities which fall within the $4,000 Cdn. allocation such as, but not limited to, sightseeing excursions, food, entertainment, and spending money. Maximum retail value of First Prize not to exceed $4,000 Cdn. All other expenses in excess of the $4,000 Cdn. maximum trip expenses are the responsibility of the individual winners. All trip and on-site trip activity arrangements, including the allocation of spending money, must be booked prior to trip through travel agent of Sponsor’s selection and are subject to Sponsor’s final approval. If actual trip expenses as approved by Sponsor are less than $4,000 Cdn., the difference not to exceed $2,000 Cdn. will be awarded to winner to be used as spending money. Trip must be completed by January 2005, or; (Option 2) A one-time payment awarded of $4,000 Cdn. in lieu of trip prize. (ARV=$4,000 Cdn.)
Prize winners and each of their respective travelling companion(s) are responsible for obtaining valid passports/visas (if required) at time of departure. Trip destination subject to Sponsor’s final approval and cannot be included as a destination that the Canadian Consular Affairs Bureau advises against travelling to at the time of departure and/or posted within the U.S. Department of State’s Travel Warnings Listing at time of departure. Additional restrictions may apply. No transfer, assignment, cash redemption (except as set out herein), or substitution of prizes (or portion thereof), except by Sponsor in its sole discretion. The Sponsor and/or its representatives reserve the right at any time to substitute any prize for any reason so long as a prize of comparable value is substituted.

Winner Selection:
On or about January 5, 2004, a winning date will be chosen at random from all promotional dates from November 1 through December 31, 2003 (“Winning Date”). Odds of a particular promotion date being selected are 1 in 61. Odds of winning are dependent on the number of eligible entries received for the Winning Date selected. E-mail and mail-in entries will be date-stamped on date received except those mail-in entries received after December 31, 2003 but on or before January 7, 2004 will be date-stamped December 31, 2003 to allow adequate time for mail delivery. On January 5, 2004, MasterCard will send the Winning Date to all MasterCard issuers and request them to electronically forward a list of all eligible MasterCard purchases for the Winning Date. On or about February 2, 2004, selected entrants will be selected in a random drawing at 12:00PM EST in Toronto, Ontario, from among all eligible entries received by mail, online or by transaction for the Winning Date by an independent judging organization whose decisions are final and binding in all matters relating to this Sweepstakes. The first 3 selected entrants will be eligible to win the Grand Prizes and the remaining 25 selected entrants will be eligible to win the First Prizes. Selected entrants will be notified by telephone and/or mail and must correctly answer a time-limited, mathematical question, to be administered by phone or mail, in order to be declared a winner. Prizes will be awarded to the primary account holder named on the MasterCard card used to make the qualifying purchase entry (as determined by the MasterCard member financial institution’s account records), or the individual named on the online or mail-in entry. In the event a corporate MasterCard card winning account is selected, prize will be awarded to the individual named on the MasterCard card that is used to transact the winning entry (as determined by the MasterCard member financial institution’s account records) and, if awarding of prize is in conflict with corporate written policy, prize will be forfeited and an alternate winner will be selected. Limit one prize per person or household.

Winner Selection:
All prize winners will be required to execute and return an Affidavit of Eligibility, Liability Release and Publicity Release within 20 days of issuance of notification. Travelling companions (if a minor, their respective parent or legal guardian) will be required to sign and return a Liability Release and Publicity Release prior to the issuance of travel documents. Non-compliance with any of the foregoing may result in disqualification and awarding of the prize to an alternate winner. If any prize notification letter or prize is returned as undeliverable, or the signed Liability and Publicity Release is not returned within 20 days of issue of notification, the winner will be disqualified and an alternate winner may be selected. By participating, entrants agree to be bound by these Official Rules and agree that: 1.) Sponsor, MasterCard Canada, MasterCard member financial institutions, and each of their respective parent companies, affiliates, subsidiaries, advertising/promotion agencies and entities related to the management, coordination or fulfillment of the prizes (collectively, “Released Parties”) shall have the right and permission to use their names, voices, cities/provinces of residence, photographs, and/or likenesses for advertising and/or trade and/or any other purpose in any media or format now or hereafter known without further compensation, permission, or notification; and, 2.) Released Parties and their designees and assigns and all of their respective officers, directors, employees, representatives and agents shall have no liability and will be held harmless for any liability, loss, injury or death to entrant or any other person, including, without limitation, damage to personal or real property, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of a prize (including any travel or prize activity related thereto) or participation in this Sweepstakes. Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement. Unless a participant otherwise consents, all information obtained for this contest will be used only for the purpose of conducting this contest.
