All entries, whether submitted by using a consumer MasterCard® credit/debit card, described below, or by mail, have an equal chance of winning.
Eligibility:: The Find Your Way Sweepstakes is open to all MasterCard® Cardholders, regardless of their country of origin or nationality, who are at least 18 years of age or older, except for employees and immediate family (i.e., spouses, parents, children, and siblings and their respective spouses) and those living in the same household of MasterCard International Incorporated (the “Sponsor”), the Graycliff Hotel, Scotiabank and their respective parent companies, affiliates, distributors, subsidiaries, retailers and advertising/promotion agencies, including the local company responsible for the implementation and management of this program, Diane Phillips & Associates of East Bay Street, Nassau, Bahamas, and MWorks, a subsidiary of McCann-Erickson Puerto Rico, promoters of the program, located on Road 176, Victor Labiosa Ave., Km. 1.6, RG Plaza Cupey, 3rd Floor, San Juan, Puerto Rico 00926 (collectively, the “Released Parties”). This sweepstakes is subject to all applicable federal, state, and local laws and regulations. Void where prohibited.
How to Enter:1) Eligible MasterCard Cardholders who make purchase transactions with a MasterCard credit or debit card at any establishment accepting MasterCard cards or cash withdrawals at Scotiabank ATM’s in Nassau/Paradise Island, Bahamas, can participate by submitting all their transaction receipts made from October 1, 2009, through December 31, 2009, beginning at 12:00:01 AM Eastern Standard Time (“EST”) on 10/01/09 and ending at 11:59:59 PM EST on 12/31/09. To qualify as a participant in the MasterCard Find Your Way Sweepstakes, eligible MasterCard cardholders need to register at www.findyourwaywithmastercard.com, by filling out the online registration form with their name, last name, and e-mail address, and provide transaction information as follows: (a) name of the establishment; (b) amount of the transaction. Only valid with proof of transaction receipts made in Nassau/Paradise Island during the promotion period. Cardholders may register to participate at any time during the promotion period. Account adjustment transactions/returns, PIN–based, international and Business card transactions, late payment fees, over–limit or over–draft fees, return check fees, check re–order fees, cash advances, annual fees, balance transfers and/or other fees assessed on your account are not considered eligible transactions for sweepstakes entry. Entries from unauthorized card use or made with lost, stolen, or fraudulent consumer debit MasterCard cards are void. Winning accounts must be in good standing and not otherwise have privileges suspended. Only transactions made on Nassau/Paradise Island, Bahamas, during the Promotion Period are eligible for entry. 1) Each time a cardholder (domestic/international/business) submits his/her purchase or ATM transaction entry information it is automatically registered as one (1) valid participation. 2) To enter the sweepstakes without making a purchase, print your name, complete mailing address, telephone number, age, the first six digits of your MasterCard card account number and issue date and the words “Find Your Way with MasterCard Sweepstakes” on a plain 3”x 5” piece of paper and mail it in a sealed, stamped and printed #10 envelope to: Find Your Way With MasterCard Sweepstakes, P.O. Box 9023389, San Juan Puerto Rico 00902-3389. Enter as often as you wish by mail or by purchase, but each entry must be mailed or registered as indicated above, separately, and must be received by 1/09/2010. No photocopied, computer-generated facsimile, mechanically-reproduced, or mass-produced entries are permitted. Your use of your consumer credit/debit MasterCard card to make a purchase and/or your purchase code submission via Internet to the MasterCard website, or your submission of a 3” x 5” mail–in entry constitutes your consent to participate in this sweepstakes and your consent for the sponsor to obtain, use, and transfer your name, address and other information for the purpose of administering this sweepstakes. The sponsor and released parties are not responsible for lost, incomplete, illegible, late, misdirected, stolen, postage–due, or mutilated entries or mail; any error, omission, interruption, defect or delay in transmission, 3rd party transaction classification, transaction processing, or communication; technical or mechanical malfunctions; failures or malfunctions of phones, phone lines, or telephone systems; errors in these Official Rules, in any sweepstakes–related advertisements or other materials; human–processing errors; failures of electronic equipment, computer hardware or software; or inaccurate entry information, whether caused by equipment, programming used in the sweepstakes, human error, or otherwise. The sponsor reserves the right, at its sole discretion, to void any and all entries of entrants whom the sponsor believes has attempted to tamper with or impair the administration, security, fairness, or proper playing of the sweepstakes.
Prizes: First Prize: One (1) Free Weekend Stay at the Graycliff Hotel & Restaurant in Nassau/Paradise Islands, Bahamas. The prize is valid for two persons for 4 days/3 nights with daily continental breakfast only. The 12% Government tax on the room, daily maid service charge of $8.50 US, all service charges on the continental breakfast, and any and all incidentals such as additional meals, room service, bar, mini-bar, personal calls, tours and other purchases are not included. The prize includes standard double-occupancy run of house hotel accommodation and USA round-trip coach air transportation from a major USA airport nearest the winner’s residence, or a selected US airport determined by MasterCard for non-USA winners residing outside the US; Second Prize: Two (2) MasterCard Debit Cards valued at $250 US each; Third Prize: Three (3) MasterCard Debit Cards of $100 US each. Stays at the Graycliff Hotel & Restaurant will be valid until October 30, 2010. Stays are neither transferable nor redeemable for cash and are subject to space availability. To redeem their trip, winners of the first prize will need to submit their redemption certificate to the Graycliff Hotel and a confirmation will be sent directly to the winner, confirming the reservation date, no later than 30 days prior to travel dates. Certain restrictions apply: no reservations will be made during blackout dates, i.e. four days before and after major holidays (Easter, US Thanksgiving, Valentine’s Day, US Labor Day and US Memorial Day), including from December 20–January 4, inclusive. The total amount of prizes: One (1) weekend stays at Graycliff Hotel & Restaurant, Two (2) MasterCard Debit Cards of $250 US each and three (3) MasterCard Debit Cards of $100 US each. The approximate retail Value (“arv”) of all prizes is $5,000. The actual value of the prize will vary depending on the final flight itinerary. The trip must be taken on dates specified by the sponsor. Once air transportation and hotel accommodations are confirmed, no changes can be made. Federal, state, & local taxes of the United States of America or any other territory outside the United States of America and all other expenses not specified herein are the winners’ sole responsibility. Travel & hotel accommodation restrictions apply. Minors (if any) must be accompanied by a parent or legal guardian, and winner and guest must travel on the same itinerary. Winner and guests must have valid required documentation (passports/visas, if required) prior to time of departure and are responsible for obtaining all such travel documents. Prize details not specifically set forth herein are at the sponsor’s sole discretion. On the same date of the sweepstakes, four alternate winners will be selected in order to substitute the winners if, for any valid reason, they do not or cannot accept the prize.
Winner Selection: The sweepstake’s drawing will take place on January, 20th, 2010 from among all the entries received from MasterCard cardholders between October 1, 2009, and December 31, 2009. The odds of winning the grand prize will depend on the total number of eligible entries received during the promotion period. For each random drawing, a total of twelve (12) individual participations will be selected: the 6 selected winners and 6 extra entries, in the event a selected winner does not qualify.
All drawings will be conducted before an attorney and notary public whose decisions are final and binding in all sweepstakes matters. Prize Winners will be notified by telephone and certified mail. In the event that a potential winner is selected via a MasterCard consumer credit/debit card transaction, the prize will be awarded to the primary account holder (as determined by the MasterCard customer financial institution’s account records and subject to said financial institution’s timely identification of the primary account holder) named on the account accessed by the consumer credit MasterCard card used to make the entry. If the awarding of a prize is not feasible after the sponsor's good faith effort to obtain account holder information from the applicable MasterCard customer financial institution, the prize will be considered forfeited and an alternate winner will be notified. Limit of one (1) prize per person, immediate family member, or household. Miscellaneous: No transfer, assignment, cash redemption or substitution of prize (or portion thereof) will be granted, except by decision of the sponsor. The prize may be substituted for unavailability or impossibility, and for a prize (or applicable portion thereof) of equal or greater value. Winners will be required to execute and return a notarized affidavit of eligibility, liability release and (where legal) publicity release within (3) days of issuance of notification. In the event that the promotion is open to those who are under the age of majority in their country of residence: This is inconsistent with the above requirement that the winner be an adult. In the event that the winner is less than 18 years of age or a minor in their country of residence, the required paperwork must be signed by the winner’s parent or legal guardian on behalf of the minor. The release must specify that the parent is acknowledging all the matters discussed here and agreeing that MasterCard International is not responsible and so should get their own insurance to cover the children. IF NECESSARY: Traveling companions (if a minor, their respective parent or legal guardian) will be required to sign and return a liability release and (where legal) publicity release prior to the issuance of travel documents. Non-compliance with any of the foregoing may result in disqualification and the awarding of the prize to an alternate the winner. If any prize notification letter is returned as undeliverable, winner will be disqualified and an alternate winner may be selected. By participating, entrants agree to be bound by these Official Rules and further agree that: 1) released parties and their designees and assigns shall have the right and permission to use (unless prohibited by law) their name, voice, city/state of residence, photograph and/or likeness for advertising and/or trade and/or any other purpose in any media or format now or hereafter known without further compensation, permission, or notification; and 2) released parties and their designees and assigns and all of their respective officers, directors, employees, representatives and agents shall have no liability and shall be held harmless for any liability, loss, injury or death to entrant or any other person, including, without limitation, damage to personal or real property, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of the prize (including any travel or prize activity related thereto) or participation in this sweepstakes.
